[Some Successful Cases]

1. Civil loan disputes

Liu * and Gao * are relatives of Miao * and Liu *1. Liu * and Gao * are a married couple, while Miao * and Liu *1 are also a married couple. Miao * needed funds for working capital and borrowed money from Liu * and Gao *. Out of a desire to help, Liu * and Gao * used their own savings to lend money to Miao * first. Miao * promised to repay the principal on time and pay interest if the principal was not repaid on time, with an agreed monthly interest rate of 5%. Liu * and Gao * lent a total of 4,656,500 yuan and agreed to repay the loan by April 8, 2016. By April 8, 2016, Miao * and Liu *1 had repaid a total of 3,567,588 yuan in principal, leaving a remaining principal of 1,088,912 yuan and interest. Subsequently, Miao * and Liu *1 neither paid interest to Liu * and Gao * nor repaid the loan principal. Therefore, they entrusted lawyer Fu Xiaofei to represent them. In the end, the lawyer not only recovered the loan for the clients, but also calculated the interest exceeding the principal at an annual rate of 60%, 24%, and 15.4%. II. Inheritance disputes

Ms. Feng and her husband, Liu * , are remarried couples who did not have any children after their marriage. Liu * had a daughter, Liu * 1, with his ex-wife. After Liu * and his ex-wife divorced, Liu * 1 has been living with her mother. However, unexpectedly, Liu * died of illness on September 4, 2017, without leaving a will. III. Inheritance disputes: Parents-in-law oppose their daughter-in-law inheriting her son's estate

The in-laws sued their daughter-in-law, Huang * *, to the court on the grounds of a dispute over inheritance by will, requesting that the two plaintiffs inherit Houses No. 1042 and No. 1002; inherit the son's funeral expenses, pensions, housing provident funds, enterprise annuities, etc. totaling 1,096,844.44 yuan; and inherit the insurance company's compensation of 236,580.50 yuan. The daughter-in-law, Huang *, entrusted Lawyer Fu Xiaofei to act as her agent, and she successfully inherited the houses in Chaoyang District of Beijing, bank balances, insurance compensation, and personal portions of pensions, enterprise annuities, provident funds, and bonuses; as well as a one-time pension and funeral expenses of 1,033,236.65 yuan.

IV. Lawsuit against the enforcement of a judgment: Successfully excluding the court's enforcement of the property involved in the case

Wang Xiaoqin and Liu Weirong registered their marriage, and in November of the same year, their daughter Liu Tong was born. On September 3, 2019, Liu Weirong and Wang Xiaoqin signed a "Divorce Agreement" and completed the divorce formalities. On June 9, 2020, Liu Weirong, as a resettled person, signed a "House Resettlement and Compensation Agreement for Area XXXX in A Town, Chaoyang District, Beijing City" with the People's Government of A Town, Chaoyang District, Beijing City. The agreement specified that Party B (Liu Weirong) currently includes his wife Wang Xiaoqin and their daughter Liu Tong. Later, Liu signed a "House Resettlement and Accommodation Agreement for Area XXXX in A Town" with a real estate development company, which identified three resettled individuals and a resettlement area of 150 square meters. He selected to purchase resettlement houses No. 1506, 1308, and 702. Later, due to a dispute over the housing lease contract between Liu and Zhang Xiaoli, the court ruled that Liu Weirong needed to pay Zhang Xiaoli over 6.87 million yuan in demolition compensation. Zhang Xiaoli applied for forced execution, and during the execution process, the court seized and planned to auction the three aforementioned houses. After the plaintiffs Wang Xiaoqin and Liu Tong's objections to the execution were rejected, they entrusted lawyer Fu Xiaofei to file a lawsuit challenging the execution of the case, claiming ownership of two of the houses and requesting a halt to the execution and confirmation of the house ownership. A company in Heilongjiang sued Kuaishou (Chengdu KuaiGou Technology Co., Ltd.) over a dispute concerning a network service contract. The company in Heilongjiang is a merchant on Kuaishou, but Kuaishou deducted penalty fees of 500,000 yuan, 50,000 yuan, and 20,000 yuan from the company's account on the grounds that the company violated platform rules. The company in Heilongjiang entrusted lawyer Fu Xiaofei to help recover the penalty fees of 420,000 yuan from Kuaishou.

VIII. Disputes over sales contracts: won the case in both the first and second instance trials

Du * and Qu * signed a contract, agreeing to transfer the XX Social Registration Service Station and Vehicle Service Co., Ltd. that Du * operated to Qu *, with a transfer price of 4 million yuan. After the contract was signed, Qu * still defaulted on the transfer payment of 1 million yuan and refused to pay it. Du * entrusted Lawyer Fu Xiaofei, who filed a lawsuit with the court. In the first-instance trial, Qu * filed a counterclaim, alleging that we failed to guarantee the "uniqueness of the service station" and demanding that we return 2 million yuan of the transfer payment to him, and submitted relevant audio evidence. In the end, the first-instance court rejected his counterclaim and ordered Qu * to pay us 1 million yuan in transfer payment and interest. After Qu * appealed the first-instance judgment, Lawyer Fu Xiaofei argued vigorously, and the second-instance court ultimately upheld the first-instance judgment.

IX. Division of jointly owned property: Properly divide the property and obtain the house usage fee

After his father's death, Huang (the younger brother) has been occupying the property in Chaoyang District, Beijing, alone and illegally changing the door locks, which resulted in Huang (the older brother) being unable to enter and use it. Faced with this dilemma, Huang (the older brother) entrusted lawyer Fu Xiaofei, who, after investigating and collecting evidence, prepared sufficient litigation materials. The court ruled that Huang (the older brother) and Huang (the younger brother) should properly divide the property as joint owners, and Huang (the younger brother) also paid the corresponding housing usage fees.

Ten, infringement disputes: the right to life, the right to physical integrity, and the right to health

Wang went to Ningxia on a business trip. That night, his Ningxia friends invited him to dinner, with 12 people attending the meal. During the dinner, many people urged him to drink alcohol. Afterward, Wang fainted and was sent to the hospital, where he later died. Wang's parents sued the 10 people who attended the dinner at the Ningxia Intermediate Court, demanding compensation of 3,634596.9 yuan. Wang's wife and daughter, as third parties, entrusted lawyer Fu Xiaofei to help them obtain death compensation, medical expenses, nutrition fees, hospitalization subsidies, dependents' living expenses, loss of income, nursing fees, and other compensation.
